Under the 2005 Bankruptcy Abuse Prevention and Consumer Protection Act, all debtors who want to obtain relief under Chapter 7 or Chapter 13 are required to obtain a certificate of pre-bankruptcy credit counseling within 6 months of the filing to qualify for bankruptcy protection. You will also be required to obtain, generally from the same provider, a certificate evidencing you have completed a personal financial management course if the choice is Chapter 7. The cost of these certificates are between $35 - $50 each. If you are in Chapter 13, the Standing Chapter 13 Trustee provides the financial management training. A list of approved credit counseling providers can be obtained at http://www.usdoj.gov/ust/eo/bapcpa/ccde/index.htm.

In addition to completing a pre-bankruptcy credit counseling interview. Debtors must provide the law office with a full six months of proof of income plus their tax returns for the prior 2 years in order to qualify for bankruptcy protection.
